Welcome to Libya Eats (“Libya Eats”, “we”, “our”, “us”).

These Terms of Service (“Terms”) govern your access to and use of the Libya Eats website, mobile applications, and related services (collectively, the “Platform”).

By using Libya Eats, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.


1. Overview of the Service

Libya Eats is an online marketplace that connects independent chefs and home cooks (“Chefs”) with customers (“Customers”) who wish to purchase freshly prepared food (“Meals”) for delivery or pickup.

Libya Eats facilitates discovery, ordering, and payments between Customers, Chefs, and Drivers.
However, Libya Eats does not prepare, cook, package, or deliver any food.
All meals are prepared and sold directly by the Chef, not Libya Eats.


2. User Roles
  • Customers: Users who browse, order, and purchase food through Libya Eats.

  • Chefs: Independent individuals or businesses who list, prepare, and sell food items through the Platform.

  • Drivers: Independent delivery providers who may deliver food on behalf of Chefs or Customers.

A user may hold more than one role (e.g., a Chef may also be a Customer).


3. Libya Eats Is a Marketplace, Not a Food Provider

Libya Eats acts solely as a technology platform to enable transactions between users.
We are not a restaurant, caterer, or delivery service.
All purchases are made directly between Customers and Chefs.

Libya Eats:

  • Does not control or guarantee the quality, safety, legality, or taste of Meals.

  • Does not verify Chef qualifications, food safety standards, or kitchen conditions.

  • Is not responsible for delivery times, food freshness, or accuracy of ingredients.

  • Is not liable for any foodborne illness, allergic reaction, or dissatisfaction.


4. Chefs as Independent Sellers

Each Chef is an independent business owner.
Chefs are not employees, agents, or partners of Libya Eats.

Chefs are solely responsible for:

  • Complying with all applicable food preparation, hygiene, labeling, and safety regulations.

  • Holding any licenses or permits required to operate.

  • Accurately listing ingredients and allergens.

  • Setting and updating menu prices.

  • Managing refunds, customer complaints, or disputes related to their Meals.

Libya Eats may assist in dispute resolution but is not obligated to intervene.


5. Account Registration and Responsibilities

To use certain features, you must create an account. You agree to:

  • Provide accurate, complete, and up-to-date information.

  • Keep your login credentials secure.

  • Be responsible for all activities under your account.

  • Notify us immediately if you suspect unauthorized access.

Libya Eats may suspend or terminate any account violating these Terms or engaged in fraudulent or unsafe practices.


6. Orders, Payments & Fees
  • Customers pay for Meals via secure online payment through the Platform.

  • Libya Eats collects the payment on behalf of the Chef and transfers the amount (minus applicable platform fees and taxes) to the Chef.

  • Delivery fees and service fees are shown at checkout.

  • Prices may vary based on distance, time, or promotion.

Taxes:
Each Chef is responsible for complying with tax laws applicable to their business.
Libya Eats may calculate and remit applicable sales or VAT taxes where required by law.


7. Refunds and Cancellations

Refunds, replacements, or cancellations are handled case-by-case.
Libya Eats may issue refunds at its discretion in cases such as:

  • Order not received.

  • Meal not as described.

  • Food quality or safety issues reported promptly.


8. User Conduct

You agree not to:

  • Post false, misleading, or harmful information.

  • Harass, abuse, or discriminate against other users.

  • Circumvent payments through Libya Eats (e.g., arranging off-platform orders).

  • Sell or promote items other than food intended for sale through the Platform.

  • Violate local food safety, delivery, or consumer protection laws.

  • Upload harmful code or misuse the Platform.


9. Ingredients, Allergens & Food Safety

Chefs must list all key ingredients and known allergens.
Libya Eats does not verify this information and is not responsible for inaccuracies.

If you have allergies or medical conditions, you are responsible for confirming ingredients directly with the Chef before ordering.


10. Delivery Services

Deliveries may be handled by independent drivers (“Drivers”) or by the Chef directly.
Libya Eats does not employ or manage drivers and is not liable for delivery delays, damages, or incidents that occur during transit.


11. Reviews and Ratings

Customers may review Meals and Chefs. Reviews must be honest, fair, and not defamatory.
Libya Eats reserves the right to remove reviews that violate these Terms or our Community Guidelines.


12. Intellectual Property

All website content, logos, images, and platform code are the property of Libya Eats or its licensors.
Users retain ownership of content they upload but grant Libya Eats a royalty-free license to display, promote, or share it in connection with the service.


13. Limitation of Liability

To the fullest extent permitted by law:

  • Libya Eats provides the Platform “as is” without any warranties.

  • Libya Eats is not responsible for food safety, delivery issues, or user behavior.

  • Libya Eats’s total liability shall not exceed the amount paid by you for the specific transaction in question.


14. Termination

Libya Eats may suspend or terminate access to the Platform for:

  • Violation of these Terms,

  • Unsafe or illegal practices, or

  • Fraudulent activity.

Users may delete their accounts at any time through account settings.


15. Disputes & Governing Law

These Terms are governed by the laws of England and Wales (or Libya, if operated locally).
Any disputes will be resolved exclusively in the courts of that jurisdiction.

Libya Eats may offer informal dispute resolution before any legal action is taken.


16. Privacy

Your personal data is handled according to our Privacy Policy, which explains how we collect, use, and protect information.
